TACO BELL UK LOYALTY PROGRAM – TERMS AND CONDITIONS

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. THESE TERMS AND CONDITIONS (“TERMS”) APPLY TO TACO BELL’S LOYALTY PROGRAM IN THE UNITED KINGDOM (THE “LOYALTY PROGRAM”). THESE TERMS WILL GOVERN YOUR PARTICIPATION IN THE LOYALTY PROGRAM FROM THE DATE YOU REGISTER FOR AN ACCOUNT AND THROUGHOUT YOUR MEMBERSHIP (“MEMBERSHIP”), INCLUDING YOUR COLLECTION AND REDEMPTION OF ANY POINTS AND YOUR USE OF ANY REWARDS.

To participate in the Loyalty Program, you will need to download the Taco Bell mobile app (“App”). The promoter of the Loyalty Program is Taco Bell UK and Europe Limited, trading as TACO BELL, of Orion Gate, Guildford Road, Woking, Surrey GU22 7NJ (“we”, “us” or “our” or “Taco Bell”). When we use “you” or “your” we’re talking to you, the person who has a Membership as part of the Loyalty Program.

The Loyalty Program

Taco Bell offers the Loyalty Program to its customers, through which customers can earn and redeem points (“Points”) and exchange those Points for rewards at participating Taco Bell® restaurants in the United Kingdom, in accordance with these Terms (“Rewards”). For your nearest Taco Bell® restaurant, please see https://locations.tacobell.co.uk/.

Eligibility and your account

The Loyalty Program is open to all United Kingdom residents, aged 18 or above, who download our App from the Apple App Store or the Google Play store and create a valid account. You will need to have a compatible smartphone to download the App and participate in the Loyalty Program. The Loyalty Program is only for consumer use – businesses are not eligible for Membership for use by their employees – and each eligible individual can only register for one account/Membership.

To create an account you are required to provide your contact information, including a valid email address and phone number. Only one account can be registered per email address. Taco Bell reserves the right to verify your eligibility to participate in the Loyalty Program and to create an account. You are responsible for the security of and activity conducted through your account/Membership. Please keep your account details secure. You should treat Points like cash – if someone else accesses your Membership, then you may lose Points earned in the same way as if cash was stolen from you and such Points will not be replaced by Taco Bell.

The App

The App is free to download. However, you will be responsible for any connection or data charges arising from your download, installation or use of the App. Your account (including your current Points balance) will only update within the App at times when you have a current wi-fi or mobile connection (and have mobile data turned on).

Collecting Points

Following creation of your account, you can start collecting Points.

To earn Points you must:

For in-store purchases: (a) visit a participating Taco Bell® restaurant in the UK; (b) spend at least £1 in a single transaction for food and drink purchases; and (c) present the QR Code (or 4 digit code) within the App for scanning / registration at the point of service at the till, before payment; or

For in-App purchases: (a) log-in to the App and select the participating Taco Bell® restaurant you will collect from or want your order delivered from, and (b) spend at least £1 in a single transaction for food and drink purchases (excluding delivery fees)..

You currently cannot earn Points or redeem Rewards for orders placed through our delivery partners (i.e. Uber Eats, Deliveroo or Just Eat).

Points cannot be awarded retrospectively.

You can earn Points as follows:

Loyalty Program tier Number of Points in your account Points earned

Mild 0-749 Points 10 Points for every complete £1 spent

Hot 1000+ Points 10 Points for every complete £1 spent

No Points will be awarded for any part of the purchase price which is not a complete £1 (so, for example, if you spend £5.49, you will receive 50 points if you are in the Mild or Hot Tiers; you will not receive any additional points for the £0.49 balance of the purchase price).

Points will usually appear in your account within 24 hours.

Points are personal to your Loyalty Program account/Membership and cannot be pooled with the Points earned by another person and/or redeemed together.

You can check your Points balance on your account by signing in on the App. You can also confirm your Points balance at any time by contacting Taco Bell customer services using this email contact: TBUK_APP_Support@yum.com (and have your account details to hand).

Taco Bell reserves the right to correct or amend your Points balance in your account if it believes that an error has occurred. If you wish to query such correction or amendment to your Points balance, please contact us using this email contact: TBUK_APP_Support@yum.com (and have your account details to hand).

Referral Scheme

If you refer another eligible person to the Loyalty Program and they create a valid account and spend at least £1 in a single transaction for food and drink purchases using the Loyalty Program as set out in paragraph 4.2 above (a “Referral“), then you will be awarded 50 Points (“Referral Scheme“). You can refer up to ten (10) people to the Loyalty Program and so receive 50 Points for each of the ten (10) Referrals made. For the avoidance of doubt, you will not receive any Points or other reward for any Referrals made by you which are in excess of ten (10) Referrals. Taco Bell reserves the right to reject any Referral which it deems, in its sole discretion, to have been made via agents, third parties, organised groups or any automated or duplication method or is (or could in Taco Bell’s opinion be) fraudulent. Taco Bell reserves the right to withdraw, amend or extend the Referral Scheme at any time in its absolute discretion.

Redeeming Rewards

To redeem a Reward you must:

In store: (a) visit a participating Taco Bell® restaurant; (b) present your QR Code/ 4 digit code from the App / account at the till for scanning / registration; and (c) inform the cashier you would like to redeem a Reward using your Points, including the particular Reward you would like, at the point of service at the till before your transaction has been concluded; and

In-App: (a) log-in to the App and select the participating Taco Bell® restaurant you will collect from , and (b) select the Reward you would like to redeem and follow the instructions.

Points cannot be redeemed retrospectively against any item(s) which you have already purchased.

You may use your Points to claim Rewards as follows:

120 Points = one of the following: 1x nacho cheese sauce, cinnamon twist, cheesy roll up or small drink

250 Points = one of the following: 1x Nachos Regular, Mini Quesadilla, soft taco or large drink

350 Points = one of the following: 1X Cravings Value Burrito, Fries with Nachi Cheese Sauce or Churros and Dip

500 Points = £5 off your next order

The Points are not cumulative so, once you have used them to for one Reward, they will disappear from the App and your Points balance will be zero. For example, if you have 120 Points then you can exchange them for a Reward in paragraph 6.3(a) and, if you do, your Points balance will return to zero. Alternatively, you can save your Points until you have enough for a Reward which requires more Points.

You must have sufficient Points available (and use only Points) to redeem the relevant Reward. You cannot make a part payment using Points or ‘top up’ a redemption with cash or other payment method.

You must have the number of Points required for a Reward in your account as shown in the App at the time of redemption. You cannot redeem Points which have not yet been credited to your account. You will not earn Points on items on the Taco Bell® restaurant menu which you claim as part of a redemption of Points. Rewards may not be redeemed in conjunction with any other offers, promotions or discount vouchers. No refunds will be granted for the Rewards. All Points which you earn during the twelve month period from the date you create your account for the Loyalty Program (or the anniversary thereof) (the “Relevant Period“) which are not redeemed as Rewards during the same Relevant Period will automatically be forfeited and removed from your account, and you will not be able to redeem Rewards using those Points. Forfeited Points cannot be reinstated. To reactivate your account at any point (with a nil Points balance), please contact us using this TBUK_APP_Support@yum.com. Menu Item Rewards are subject to availability at participating Taco Bell® restaurant. Taco Bell reserves the right to change the Rewards from time to time in its absolute discretion. Taco Bell also reserves the right (but is not obliged) to substitute any Reward for a similar or alternative free product or offer of equivalent or greater value.

Termination of your Membership

If at any time you wish to terminate your Membership and withdraw from the Loyalty Program, please contact us at TBUK_APP_Support@yum.com (and have your account details to hand). Alternatively, you can simply cease using your Membership and delete the App.

We reserve the right to limit or terminate your Membership (including without limitation by terminating the collection of Points and/or redemption of Rewards) and/or take any other action it considers appropriate if we reasonably suspect that you are not eligible to participate in the Loyalty Program under these Terms, there is misconduct, fraudulent, unauthorised or inappropriate use of your account (including without limitation tampering with or duplicating Points), you have provided us with false or misleading information or you have otherwise not complied with these Terms.

If you terminate your Membership or if we terminate your Membership, then we will forfeit all of your unused Points at the date of termination.

Changes to your details

Your personal details must be kept up to date and so if you need to change any of the details you provided to us when you registered for your account/Membership, then please update your details through the App.

Our liability to you

Our legal duty. We are under a legal duty to provide a Loyalty Program that conforms with the description on the App and in these Terms. We will provide the Loyalty Program with reasonable skill and care.

Availability: We aim to ensure that the App and the Loyalty Program are available but, of course, due to the nature of mobile and online services, we cannot guarantee this at any time. We also do not guarantee that the App will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs, platforms and devices to access the App and should use your own virus protection software.

We are responsible for foreseeable loss or damage caused by us. If we fail to comply with our obligations to you under these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into a contract on the basis of these Terms.

We are not liable for business losses. You agree not to use the Loyalty Program or any features on the App, for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

We are not liable for matters outside of our control. Except to the extent that liability cannot be excluded or limited as a matter of law, Taco Bell accepts no responsibility or liability for (a) accounts which are created using incorrect or inaccurate information; (b) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications, line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers used in any aspect of the operation of the Loyalty Program or App; (c) inaccessibility or unavailability of any network or wireless service, the Internet and/or any website; (d) any injury or damage to any person’s computer(s) or mobile device(s) which may be related to or result from any attempt to participate in the Loyalty Program or to download any materials in connection with the Loyalty Program or App; or (e) any matter outside of its reasonable control.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. We therefore do not in any way exclude or limit our liability under or in connection with any contract with you based on these Terms for:

death or personal injury caused by our negligence;

fraud or fraudulent misrepresentation; or

any matter for which it would be illegal for us to exclude or attempt to exclude our liability.

General

Personal information: Any personal information provided in connection with the Loyalty Program will be used, shared and retained as set out in the Privacy Notice posted at https://www.tacobell.co.uk/privacy-policy.

Variation and termination:

Taco Bell reserves the right to vary or cancel the Loyalty Program and/or to amend, vary or alter these Terms, to the extent it considers it necessary to do so.

We will provide you with reasonable notice of any cancellation or material variation of the Loyalty Program or material amendments to the Terms, including by posting a notification in the App or sending you an email. If you continue to use the Loyalty Program after such notification, you will be deemed to have accepted those revised Terms.

We may from time to time make other amendments to these Terms (such as where we need to in order to comply with applicable laws). These changes will be effective upon the posting of the revised Terms to https://www.tacobell.co.uk so please check the website on a regular basis.

If you do not agree to any of these changes, you have the right to cancel your account for the Loyalty Program at any time, but you will lose the right to redeem all unused Points and Rewards.

Points and Rewards: (a) can only be earned, retained or redeemed as set out in these Terms; (b) cannot be used as any form of credit, debit, proof of age or identity, or for any other purpose; (c) have no redeemable cash value and cannot be exchanged for cash or other alternatives; (d) cannot be sold, transferred, exchanged (to other Loyalty Program members or accounts or otherwise) or used for any other purpose, except as specified in these Terms or otherwise in writing by Taco Bell; and (e) are personal to the account to which they are registered. We may from time to time run promotional campaigns where you can exchange your Points for other forms of rewards and the terms on which those Points can be exchanged will be included in separate terms and conditions which will apply to those particular promotions.

Assignment: We may transfer the benefit of the agreement with you under these Terms to any other company in the same group of companies as Taco Bell. This will not affect your rights. You may not transfer your Membership or your rights to any third parties under these Terms without our agreement in writing.

Decisions of Taco Bell: Any decision of Taco Bell is final and no correspondence or discussion will be entered into.

Conflicts: If there is a conflict in these Terms with any other terms whatsoever attached to any other advertising material in respect of the Loyalty Program, these Terms will take precedence.

Which laws apply and where you and we may bring proceedings: The Loyalty Program and these Terms (including any non-contractual disputes or claims arising out of them) are subject to English law. Any disputes must be referred to the English courts (save that consumers in Scotland and Northern Ireland may additionally bring an action in their home courts).

If a court finds part of these Terms illegal, the rest will continue in force. Each of the sections of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining sections will remain in full force and effect.

Waiver. If you breach these Terms and we choose to ignore your breach, or if we delay in taking steps against you, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms again.

Reliance on these Terms. We intend to rely on these written Terms and any document expressly referred to in them. We and you will be legally bound by these Terms.

Getting advice about your consumer rights. As a consumer, you have legal rights in relation to services that are not provided with reasonable skill and care or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.
