Taco Bell Pen Promotion Terms & Conditions (the “Promotion”)

  1. By entering the Promotion, entrants agree to be bound by these terms and conditions (the “Terms and Conditions“). Promotional materials relating to the Promotion, including all information on how to enter the Promotion, also form part of these Terms and Conditions. In the event of any conflict between any terms referred to in such promotional materials and these Terms and Conditions, these Terms and Conditions take precedence.
  2. To participate in the Promotion, entrants must: (i) be legally resident in Great Britain; (ii) be aged 18 or over; (iii) have internet access on a device that supports the Instagram application, and (iv) have a public Instagram account (i.e., an account that is not set to “private”). Employees and agents of Taco Bell or any of its subsidiary or affiliated companies or franchisees, and their immediate families and members of their households, and anyone otherwise connected with operation or fulfilment of the Promotion, are not eligible to take part in the Promotion.
  3. There is no purchase necessary for this Promotion and entry is free.
  4. To enter for a chance to win, entrants must: (i) follow @tacobelluk on Instagram (ii) like the contest post on the @tacobelluk Instagram page; and (iii) tag at least one friend in the comments of the contest post – each comment which tags a friend will qualify as one entry. Entries submitted by any other means will not be accepted, only those submitted via the official method of entry are eligible.
  5. The opening date for receipt of entries is at 12pm (UK time) on 16th April 2024 and the closing date for receipt of entries is at 4PM (UK time) on 23rd April 2024.
  6. There is no limit on the number of entries per person. Ten (10) winners will be drawn at random from all eligible entries and announced on 24th April 2024 via a direct message to the Instagram account they used to enter the Promotion.
  7. There are a total of ten (10) prizes available. This prize consists of a Taco Bell pen. Taco Bell will be sending the prize directly to the winners address, within 14 days at the end of the Promotion. 
  8. By participating in the Promotion, entrants agree that the prize is awarded on an “as is” basis, and that neither Taco Bell nor any of its subsidiary or affiliated companies, make any representations or warranties of any nature with respect to the prize.
  9. Taco Bell reserves the right, to delete any submissions that are rude, defamatory, insulting, inappropriate, racist or otherwise offensive or inappropriate. Although the Promotion may be featured on Instagram, the Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram and you agree that Instagram is not liable in any way. You are providing information to Taco Bell and not to Instagram. The information you provide will only be used for the purposes referred to in paragraph 13 below.
  10. The prize is as stated and is non-exchangeable and non-transferable.
  11. In the event that, for reasons beyond Taco Bell’s reasonable control and not related to any winner, Taco Bell is unable to award the prize as described in these Terms and Conditions, Taco Bell reserves the right to award a prize of a similar nature and an equivalent value, or at its sole discretion, the cash value of the prize.
  12. The winners may be required to provide proof of identity and any documentation as reasonably required to validate their eligibility to claim the prize and their proof of age. If a winner is found to be ineligible, or does not respond to Taco Bell’s notification of winning or provide any information requested within such notification of winning to receive the prize, Taco Bell reserves the right to require the return of the prize and to award the prize to an alternative eligible entrant through a further random prize draw of all other eligible entrants.
  13. Taco Bell will use the personal details supplied for the administration of the Promotion and for no other purpose. This information may be shared with Taco Bell’s agents and affiliates (including those outside the European Economic Area), such as where it is necessary in order to conduct the Promotion including for the prize to be delivered to the winner.  If entrants do not provide any of the mandatory information requested when entering and taking part in the Promotion, they may not take part in the Promotion.   14. By entering this Promotion, entrants confirm that any third parties they tag in the content post on Instagram have provided their consent for being tagged in such post for the purposes of this Promotion.
  15. If for any reason any aspect of this Promotion is not capable of running as planned, Taco Bell may in its sole discretion cancel, terminate, modify or suspend the Promotion or the prize, or invalidate any affected submissions. Taco Bell shall use all reasonable endeavours to notify the winners of any change of plans.
  16. Taco Bell accepts no responsibility for incomplete, corrupted, late or misdirected submissions, network failure or delay.
  17. Taco Bell must either publish or make available information that indicates that a valid award took place. The surname and county of the winners shall be provided upon request, please write to the following address for this information: Taco Bell UK, Orion Gate, Guildford Road, Woking, GU22 7NJ, no later than 7th May 2024 . If an entrant objects to any or all of his or her name and county being published or made available for these purposes, please contact Taco Bell via gemma.flynn@yum.com. In such circumstances, Taco Bell must still provide the information to the Advertising Standards Authority on request.
  18. Unless caused by their negligence, Taco Bell and its associated agencies and companies will not be liable for any loss, expense or damage which is suffered or sustained in connection with this Promotion or accepting or using the prize (including without limitation as a result of technical fault, computer or electronic malfunction, or incomplete, illegible, lost or fraudulent entries).  
  19. Nothing in these Terms and Conditions excludes liability for death or personal injury caused by its negligence, fraud or any liability which cannot be excluded or limited under applicable law.
  20. This Promotion and these Terms and Conditions will be governed by laws of Scotland, England and Wales and the courts of Scotland, England and Wales shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Promotion or these Terms and Conditions.
